Ryanair fails in its attempt to overthrow the bailout of Air Europa

The Court of Justice of the European Union (CJEU) rejects Ryanair’s appeal against the European Commission’s decision to authorize the Fund to Support the Solvency of Strategic Companies (FASEE), a program of the Spanish Government endowed with 10,000 million euros that served to rescue Air Europa with state aid of 475 million euros (Ryanair will try to overthrow all bailouts, including that of Air Europa).

In its ruling, the CJEU determined that “the aid scheme in question did not violate the principle of non-discrimination on grounds of nationality and was proportionate.”

“Ryanair has not been able to demonstrate that the Spanish aid regime produced restrictive effects that go beyond the effects inherent to this type of aid, nor that the aforementioned regime therefore constituted an obstacle to the freedom to provide services and the freedom of establishment. ”, he explains.

For example, the same court did agree with Ryanair in its complaint against the bailout worth 6 billion euros that the German Government granted to Lufthansa. In that case, the CJEU determined that the European Commission committed “various errors” when giving the green light to the recapitalization of the airline (Lufthansa is left without a state bailout because of Ryanair).
